An Oak Point rent-payer, Barbara Lee, has sued the owners or operators of the Oak Point Manufactured Housing Community located in Middleborough, Massachusetts (“Oak Point”) concerning rents charged for home sites at Oak Point since April 16, 2017. Specifically, Ms. Lee has claimed that Oak Point was supposed to charge the same rent for all home sites in the community, but instead unfairly charged higher rents each year to new rent-payers. Through her lawsuit, Ms. Lee wants Oak Point to, among other things, reimburse her for the money that she paid each month in excess of what the lowest Oak Point rent-payer paid in that month, with interest. Through her lawsuit, Ms. Lee also wants Oak Point to reimburse in the same way all other persons who have paid rent for an Oak Point home site since April 16, 2017.
Ms. Lee’s lawsuit was filed in the U.S. District Court for the District of Massachusetts (“Court”). The Court has allowed Ms. Lee’s lawsuit to proceed as a class action on behalf of persons who have paid home-site rent to the Oak Point Manufactured Housing Community located in Middleborough, Massachusetts at any time since April 16, 2017.
The Court has not decided whether Oak Point has done anything wrong. There is no money available now and there is no guarantee that any money will ever be available. (“MFM”) have sued the owners or operators of the Oak Point Manufactured Housing Community located in Middleborough, Massachusetts (“Oak Point”) concerning rents charged for home sites at Oak Point. Specifically, Ms. Lee and the MFM have claimed that Oak Point is supposed to charge the same rent for all home sites in the community, but instead is unfairly charging higher rents because of the year a resident moved into Oak Point. Through their lawsuit, Ms. Lee and the MFM want Oak Point to charge a uniform rent in the community that is the same as the lowest rent Oak Point is assessing for any home site in the community.
Ms. Lee’s and the MFM’s lawsuit was filed in the U.S. District Court for the District of Massachusetts (“Court”). The Court has allowed this lawsuit to proceed as a class action on behalf of persons who are paying or will pay home-site rent to the Oak Point Manufactured Housing Community located in Middleborough, Massachusetts (“Class Members”).

Two Miller’s Woods rent-payers, Edwin Bartok and Alan Dernalowicz, have sued the owners or operators of the Miller’s Woods and River Bend Manufactured Housing Community located in Athol, Massachusetts (“Miller’s Woods”) concerning rents charged for home sites at Miller’s Woods between January 1, 2017 and December 31, 2024. Specifically, Mr. Bartok and Mr. Dernalowicz have claimed that Miller’s Woods was supposed to charge the same rent for all home sites in the community, but instead unfairly charged higher rents each year to new rent-payers. Through this lawsuit, Mr. Bartok and Mr. Dernalowicz want Miller’s Woods to, among other things, reimburse them for the money that they paid each month in excess of what the lowest Miller’s Woods rent-payer paid in that month, with interest.
